对三纲五伦的批判和反思,是现代中国思想的一个中心话题。人伦批判肇端于清末,到五四达到高潮,然后又在社会科学界和法学界经过了长期的讨论,随着1950年《婚姻法》形成了一个比较明确的现代形态。总结百年来的批判,大体有三条线索:一,从压抑人性的角度批判传统礼教,这是最主流,同时影响也最大的批判;二,通过对法律体系的转变,在社会实践中改变传统的礼法体制;三,在社会史的研究中,对母系论的接受成为人伦批判的理论基础。
Criticism and reflection on the three classes and five bens are a central topic of modern Chinese thought. The human rights critique started in the late Qing Dynasty and culminated in the May Fourth Movement. After a long discussion in the social sciences and legal science circles, the 1950’s Marriage Law formed a relatively clear modern form. To summarize the criticism from the past 100 years, there are generally three clues: First, to criticize the traditional ethics and morality from the perspective of suppressing human nature is the most mainstream and most influential critique. Second, through the transformation of the legal system, we can change the tradition in the social practice Third, in the study of social history, the acceptance of matrilineal theory has become the theoretical basis of the human beings’ criticism.
