近几年来,随着社会经济的发展,建设不断加快,国家对土地征用越来越多,很多土地征用后,建设成了开发区、旅游度假区等。目前我国有关土地征收的法律制度存在诸多不足之处,失地农民利益受损的现象时有发生,这成为社会矛盾激化的因素之一。对于农民来说,土地是农民赖以生存的最重要的资源,农民的土地权益是农村稳定的根源,没有了土地农民几乎无法生存。本文从失地农民利益的保护现状出发,针对我国现行土地征收制度在失地农民权益保护方面存在的问题,阐述了完善农村集体土地征收制度的具体路径。
In recent years, with the social and economic development, the construction is accelerating and the state has more and more expropriation of land. After a lot of land acquisition, it has become a development zone, a tourist holiday zone and so on. At present, there are many deficiencies in the legal system of land expropriation in our country, and the damage to the interests of land-expropriated peasants has occurred from time to time, which has become one of the factors intensifying social conflicts. For the peasants, the land is the most important resource on which the peasants depend for their survival. Peasants’ rights and interests in the land are the root causes of rural stability. Without land peasants can hardly survive. Based on the protection of landless peasants’ interests, this paper aims at the existing problems of the land expropriation system in our country to protect the rights and interests of landless peasants, and elaborates on the concrete ways of perfecting rural land expropriation system.
