随着国际投资全球化的发展,次级救济在当代国际投资领域的适用范围也日益扩大,本文将从国际投资仲裁已有裁决出发,分三个层级次级救济地位上升的原因。第一,首要救济在当代国际投资争端中受限状况。第二,当地救济和国际仲裁庭之间相互作用中,次级救济适用的条件。第三,讨论影响次级救济的投资协议条款。
With the development of globalization of international investment, the scope of application of subordinate relief in the field of contemporary international investment is also widening. This article will discuss the reasons for the rise of subordinate relief at three levels, starting from the ruling on international investment arbitration. First, the primary relief is limited in contemporary international investment disputes. Second, the conditions for the application of sub-relief in the interaction between local remedies and international arbitral tribunals. Third, discuss the terms of the investment agreement that affects sub-relief.
