我国农村住房和宅基地制度是一种具有中国特色的土地制度,为了保障农民土地使用权的实现,国家出台了一系列法律法规。随着社会经济的不断发展,城乡一体化进程的不断加快,农村住房和宅基地利用问题越来越凸显出来,现行法律法规跟不上农村土地利用形势的发展,法规的不完善造成了资源的闲置浪费和不均等;在司法实践中,农村房屋买卖合同的法律适用问题涉及到宅基地使用权流转的法律难题。农村住房和宅基地利用的制度亟需创新,在科学、合理规划的基础上建立城乡统一的农村住房和宅基地利用制度。
China’s rural housing and housing site system is a kind of land system with Chinese characteristics. In order to guarantee the realization of farmers’ land use rights, the state has promulgated a series of laws and regulations. With the continuous development of social economy and the accelerating process of urban-rural integration, the problems of the utilization of housing and homesteads in rural areas have become increasingly prominent. The current laws and regulations can not keep up with the development of rural land use. The imperfect laws and regulations have caused resource Idle waste and inequality; in judicial practice, the law applicable to the contract of sale and purchase of rural housing involves the legal problems of the circulation of the right to use housing sites. The system of rural housing and homestead use is in urgent need of innovation and the establishment of a unified urban and rural housing and housing site utilization system based on scientific and rational planning.
