预告登记作为不动产登记中的一项重要制度,为德国、日本及我国台湾地区的立法所采纳。在我国,预告登记在保障当事人权利、维护不动产物权关系稳定以及交易安全等方面具有重要意义。我国物权法在预告登记的效力上的规定,与德国、日本以及我国台湾地区的立法相比较还需进一步完善。
As an important system of property registration, advance notice registration is adopted by the legislation of Germany, Japan and Taiwan of our country. In our country, advance notice of registration is of great significance in protecting the rights of parties, safeguarding the stability of real property rights and the security of transactions. The provisions of the Property Law of China on the validity of pre-registration need to be further improved compared with the legislation of Germany, Japan and Taiwan of our country.
