众所周之,《招标投标法》和《政府采购法》均有相关规定,招标采购人委托业务时,有权自行选择代理机构,任何单位和个人不得以任何方式为其指定。但在实际操作中,一些地方却是针对政府财政资金项目,采取了组建一定数量的代理机构库,招标采购人只能通过随机抽取的方式进行委托办理。实际上,交易中心组建代理机构库并不违法,但恰恰是这种只能从中“随机抽取”选择代理机构的管理模式,成了一种违法的变相指定。本文尝试从以下几个方面进行综合阐述,查找产生这一现象的原因,以及后续管理出现的问题,分析将代理机构自主选择权还给招标采购人的必要性,并对如何规范招标采购人在法律框架下选择代理机构,提出合理化的建议,以期为解决这一难题提供借鉴。
All the week, “Tendering and Bidding Law” and “Government Procurement Law” have relevant provisions, the bidding purchaser commissioned by the business, have the right to choose their own agencies, no unit or individual shall be specified in any way. However, in actual operation, some places are targeted at the government financial funds project, taken to set up a certain number of agency banks, bidding and purchasing people can only be handled by way of random selection. In fact, it is not illegal for a trading center to set up an agency pool, but it is precisely this kind of management model that can only select agents randomly from them. It becomes an illegal disguised designation. This article tries to make a comprehensive exposition from the following aspects, find out the cause of this phenomenon, and the problems of follow-up management. Analyze the necessity of returning the agency’s own choice to bidding purchaser, Select the agency under the legal framework, put forward rational proposals, with a view to provide a reference for solving this problem.
