公证制度和民事诉讼制度是我国司法制度的重要组成部分,是调整民事法律关系、解决民事法律纠纷的两个重要手段。公证作为一项非诉讼制度,其设计初衷主要在于通过公证对民事法律关系起始性的介入,利用公证员的专业法律素质对相关民事行为的合法性、真实性进行预判和修正以达到预防民事纠纷产生的作用;而民事诉讼制度,是在民事纠纷产生时,通过人民法院的居中裁判作用,确保民事纠纷得以公平、公正的顺利解决,维护社会正义。故从时间逻辑上而言,公证预防纠纷作用的发挥将降低或者消灭民事诉讼的发生几率。但与此同时,民事诉讼制度并非民事纠纷解决的唯一制度,公证制度除其预防纠纷作用外,在民事纠纷解决中也同样发挥着不可或缺的作用,那么在面对民事纠纷时,当事人就有了备选的可能。而最终导致当事人选择何种方式作为解决纠纷的手段的重要考量因素便是二者的成本分析。本文试图通过系统分析和实证分析相结合的研究方法,分析比较公证成本和民事诉讼成本,把控二者相互关系,寻求预防、解决民事纠纷经济效益和社会效益二者的最佳平衡点。
The notarial system and the civil procedure system are the important components of the judicial system in our country. They are two important means to adjust the relationship between the civil law and the civil law disputes. An important factor that ultimately leads the parties to choose which way to take to resolve a dispute is the cost analysis of the two. This article tries to analyze and compare the cost of notarization and the cost of civil litigation through the systematic and empirical research methods, and control each other to seek for the best balance between the economic benefits and social benefits of civil disputes.
