新的《民办教育促进法》规定民办学校可以选择成为营利性民办学校或非营利性民办学校。相当数量的民办学校举办者对选择走非营利性发展道路心存顾虑,原因在于新法对非营利性民办学校举办者的权力监督和制约力度较大,而对其合法权益保护不足。促进民办学校的健康可持续发展,需要保护非营利性民办学校举办者的合理权益。保护举办者的财产权要求省级政府明确对非营利性民办学校举办者进行补偿或奖励的数额,并对学校“终止办学”作出有利于举办者财产权益保护的细化界定。保护举办者的管理权要求维护董事会在民办学校人事、财务等重大事务中的决策地位和举办者在董事会中的话语权和决策权。保护非营利性民办学校的办学自主权要求赋予非营利性民办学校教学自主权、招生自主权和收费自主权。
The new Law on Promotion of Private Education stipulates that private schools may choose to become profit-making private schools or non-profit private schools. A considerable number of private school sponsors are concerned about choosing to go for a nonprofit development path because the new law oversensures and restricts the power of organizers of nonprofit private schools and protects their legitimate rights and interests. To promote the healthy and sustainable development of private schools, the legitimate rights and interests of non-profit private schools need to be protected. Protecting the organizer’s property rights requires that the provincial government clearly define the amount of compensation or rewards for those sponsored by non-profit private schools and make detailed definitions conducive to the protection of the property rights and interests of the organizers. Protecting the organizer’s management rights requires that the Board of Directors maintain its decision-making position in major affairs such as personnel affairs and finance in private schools and hold the speaker’s right of speech and decision-making in the board of directors. The non-profit non-profit school-running autonomy in running schools requires the non-profit non-profit private schools to give their teaching autonomy, enrollment autonomy and fee autonomy.
