国际法的中国观念是中国国际法理论的一部分,是中国特色法治理论的一个方面。国际法的中国观念要求充分利用法学理论的观点,并采用国际关系与国际法的跨学科研究,寻求适当的国际法认识。就当前而言,中国适于采取一种尊重现实、基于现实的国际法观念,并进而探求这种观念的理论阐释能力和现实指导意义。中国所宜采取的现实主义国际法观念包括两个方面:一是观察和思考国际法存在时秉持务实求实的精神,在国际关系的情境中准确而科学地认知国际法,避免过于乐观的理想主义迷思,也要避免国际法虚无主义,不能将国际法仅仅看成没有确定性的实证道德;二是分析国际法问题吸收和借鉴国际关系中的现实主义观点,认识到国家权力与权力体系对于国际法发展变化的核心作用。通过确立国际法的现实主义观念,可以加深中国国际法的理论化程度和实践针对性,并进而为形成国际法治的中国理论创造条件。
The concept of China in international law is a part of China’s theory of international law and is an aspect of the theory of the rule of law with Chinese characteristics. The Chinese concept of international law requires that the views of jurisprudence be fully utilized and that interdisciplinary research on international relations and international law be used to seek appropriate understanding of international law. For the time being, China is fit to adopt a concept of respecting the reality and based on realistic concepts of international law and then explore the theoretical elucidation ability and practical guidance of this concept. The realistic concept of international law that China should adopt includes two aspects: First, observe and think in the spirit of pragmatism and truthfulness in the presence of international law; accurately and scientifically understand international law in the context of international relations; and avoid the overly optimistic idealist myth , But also to avoid the nihilistic view of international law and to view international law merely as unsubstantial positivism. Second, to analyze the issue of international law, to absorb and learn from the realist perspective in international relations, and to recognize that the core of the system of state power and power for the development and changes of international law effect. By establishing the concept of realism in international law, we can deepen the theoretical and practical relevance of China’s international law and create the conditions for the formation of an international law of China.
