国家民主是宪政主义的核心原则之一。但欧债危机背景下,超国家组织的危机处理和大量国际金融决策对国家民主提出了巨大挑战。本文通过分析德国宪法法院关于德国参与危机控制的三个判决,探究国家民主原则在欧盟背景下的作用与发展。在全球化背景下,各国的大量决策受到外部势力的影响,也均具有外部效应,但仍应保障国家议会在重大问题上的民主决策权,坚持国家民主作为德国宪政主义的身份支柱。
National democracy is one of the core principles of constitutionalism. However, under the background of the European debt crisis, the handling of crises by super-national organizations and the large number of international financial decisions pose great challenges to the national democracy. By analyzing the German Constitutional Court’s three judgments on Germany’s participation in crisis control, this article explores the role and development of the principle of national democracy in the EU context. In the context of globalization, a great deal of policy decisions in various countries are influenced by external forces and also have external effects. However, the right to make democratic decisions on major issues in the national parliament should be guaranteed and the national democracy as the identity pillar of constitutionalism in Germany.
