近年来,基础教育领域内,法律纠纷频发。分析诸多案件后,笔者发现,这些法律纠纷几乎涉及教育的各方主体:学校、教师、学生、行政部门、社会等,具体表现为学生受教育权损害、校园人身伤害、招生考试徇私舞弊、拖欠教师工资及乱收费、教师人身伤害以及违法经营侵占校园等。分析成因并破解之,是依法治校必须面对的现实。查找背后的原因造成教育法律纠纷的原因,既有立法方面的宏观原因,也有学校内部管理体制等中观原因,还有个体法律意识淡薄等微观原因。在立法方面,我国虽已制定颁布《教育法》《义务教育法》
In recent years, there have been frequent legal disputes in the field of basic education. After analyzing many cases, the author finds out that these legal disputes involve almost all subjects of education: schools, teachers, students, administrative departments, and society. The concrete manifestation is that the students suffer from the right to education, campus personal injuries, malpractices in the entrance examination, default Teacher salaries and arbitrary fees, teacher personal injury and illegal occupation of the campus. Analysis of the causes and solutions is the reality that schools must face according to law. The reason behind the finding of legal education disputes lies in the macro reasons of legislation, the medium-sized reason of internal management system in schools, and the microscopic causes such as the weak legal consciousness of individuals. In terms of legislation, our country has formulated and promulgated the “Education Law” and the “Compulsory Education Law”
