物权的变动涉及到物的所有权转移的问题,对于确保物的状态的稳定、维护交易安全以及市场经济秩序的稳定具有重要的作用。物权法确定了物的公示公信原则作为物转移占有的基本原则,只有登记或交付才能转移物的所有权,是法定的物权变动准则。明确公示公信原则的基本内容,有助于该原则在物权变动中的适用,为保护权利人和第三人的权益奠定基础。本文以物权变动中的公示公信原则的理解与适用为主线展开论述,以期为物的交易安全提供合理化的建议。
The change of property rights involves the transfer of ownership of the property, which plays an important role in ensuring the stability of the property, maintaining the security of the transaction and stabilizing the market economy. The Property Law determines the public principle of publicity of goods as the basic principle of the transfer of possession of property, and only the ownership of the transferred property can be transferred after registration or delivery, which is the statutory principle of change of real right. Clearly publicize the basic principles of public trust, contribute to the application of the principle in changes in property rights, and lay the foundation for the protection of the rights and interests of right holders and third parties. This article takes the understanding and application of the public principle of public trust in the change of property rights as the main line to discuss in order to provide reasonable suggestions for the transaction security of the property.
