待确权建筑确权制度之建构

待确权建筑是指未取得建设工程规划许可证,或者违反建设工程规划许可证、影响城市规划,但尚可采取改正措施、补办手续的建筑。因各地行政机关对待确权建筑占有人的确权申请未能予以足够的重视,确权申请的结果难以预测,因而有必要建立系统、完善的确权制度,以保护确权申请人的正当权益。 To be the right to be the building that does not get the permit for the construction of the project, or in violation of the planning permit for construction projects that affect the urban planning, but can take corrective measures to re-submit the building. Due to the fact that the application of the affirmative action made by the administrative organs in various places to the affirmative construction owner fails to be given sufficient attention, the outcome of the affirmative action application is difficult to predict. Therefore, it is necessary to establish a systematic and complete affirmative system to protect the legitimate rights and interests of the affirmative-affirmed applicant .
