第一章总则第一条为了规范中央国家机关人民防空行政处罚行为,保证有效地组织人民防空,保护公民、法人或者其他组织的合法权益,根据《中华人民共和国人民防空法》(以下简称《人民防空法》)、《中华人民共和国行政处罚法》(以下简称《行政处罚法》)和其他有关法律、法规的规定,结合中央国家机关人民防空工作实际情况,制定本办法。第二条中央国家机关人民防空办公室负责管理中央国家机关各部门的人民防空工作,依法对违反《人民防空法》的行为实施行政处罚。中央国家机关人民防空办公室可以依法委托中央国家机关各部门人民防空办公室(以下简称部门人防办)实施行政处罚。
Chapter I General Provisions Article 1 In order to regulate the administrative penalties of people’s air defense in the state organs of the Central Government, ensure the effective organization of civil air defense and the lawful rights and interests of citizens, legal persons and other organizations, according to the “People’s Air Defense Law of the People’s Republic of China (hereinafter referred to as” the people Air Defense Law “), the” Administrative Punishment Law of the People’s Republic of China “(hereinafter referred to as the” Administrative Punishment Law ") and other relevant laws and regulations, and in light of the actual situation of civil air defense work by the central state organs. Article 2 The People’s Air Defense Office of the Central Government State Department shall be responsible for the work of people’s air defense in all departments of the central state organs and impose administrative penalties on violations of the People’s Air Defense Law in accordance with the law. The People’s Air Defense Office of the Central Government Organs may entrust the People’s Air Defense Office of the Central Government Offices under various departments of the Central Government (hereinafter referred to as the Civil Defense Office) to impose administrative penalties according to law.
