商号权的存在,不仅有利于保护商人的权利,还有利于保护交易相对人的利益。但是在理论上对于商号权的性质一直争论不已。而这样一种不确定的状态对于商号权的保护无疑是不利的,只有确定了商号权是一种财产性的权利,才能更好地实现商号权制度存在的目的。本文运用了内容分析和特点分析的方法,对商号权的财产性进行了分析。
The existence of the right of trade not only helps protect the rights of traders, but also protects the interests of the counterparts in the transaction. But theoretically the nature of the right to trade has been controversial. However, such an indefinite state is undoubtedly unfavorable to the protection of the quotient right. Only when it is determined that the quotient right is a kind of property right, can the purpose of the trade name right system be better realized. This article uses the content analysis and the characteristic analysis method, has carried on the analysis to the property of the trade name right.
