非农村集体经济组织成员继承农村房屋遇到的法律问题有两个:一是农村集体经济组织成员资格的界定不明确;二是农村宅基地使用权的立法规定不符合当前经济发展的需要。农村集体经济组织成员一般是指依法取得本集体经济组织所在地常住户口,并在本集体经济组织内生产、生活一年以上的人;或虽未取得本集体经济组织常住户口但其最近三年的平均收入2/3以上来自本集体经济组织土地的人。立法上将宅基地使用权规定70年的期限,对非本集体经济组织成员使用宅基地的征收土地使用费。
There are two legal problems encountered by members of non-rural collective economic organizations in inheriting rural houses: First, the definition of membership of rural collective economic organizations is not clear; secondly, the legislative provisions on the right to use rural house sites do not meet the needs of current economic development.
