随着我国市场经济不断发展,电子商务作为发展势头迅猛的经济形式成为经济发展的重要引擎。然而,发展的同时,电子商务中出现的问题接踵而至,其中,在法律层面上,制约我国电子商务健康运行的重要问题就是电子商务侵权行为以及相对应的电子商务侵权法。与传统的侵权法不同的是电子商务涉及的侵权行为有其独有的特点,它既不同于一般意义上的网络侵权,新特点突出表现侵害主体、侵权行为地、侵害客体等方面。因此对于电子商务中侵权法所涉及的基本问题必须有一个清楚的界定和研究,以此来促进我国电子商务有序进行以及有效地保障电子商务主体的合法权益。
With the continuous development of the market economy in our country, e-commerce has become an important engine of economic development as a rapidly developing economic form. However, at the same time of development, the problems that appear in e-commerce come one after another. Among them, on the legal level, the important issues that restrict the healthy operation of e-commerce in our country are the e-commerce infringement and the corresponding e-commerce tort law. Different from the traditional tort law, the infringement involved in e-commerce has its own unique characteristics. It is different from the network infringement in the general sense, and the new features highlight the infringement subject, the infringement act and the infringement object. Therefore, there must be a clear definition and study of the basic issues involved in tort in e-commerce, so as to promote the orderly conduct of e-commerce in our country and effectively protect the legitimate rights and interests of e-commerce entities.
