在现代社会中,政府信息公开既是公众获取重要信息资源的直接途径,也是公众监督政府行为、实现公民知情权的重要手段。《政府信息公开条例》实施三年多以来,我国的政府信息公开已取得了较为显著的成效,但无论是立法还是实践中还存在着一些问题和不足。其中,信息公开相对人权利救济机制的不完善成为影响和制约我国政府信息公开进一步良性发展的重要障碍。 In modern society, government information disclosure is not only a direct way for the public to access important information resources, but also an important means for the public to supervise government behavior and realize citizens’ right to know. Since the implementation of the “Regulations for the Disclosure of Government Information” for more than three years, the government information disclosure in our country has achieved remarkable results. However, there are still some problems and shortcomings in the legislation and in practice. Among them, the imperfection of the system of right-relief for the right to disclose information has become an important obstacle that affects and restricts the further sound development of the government information in our country.
