专利一般通过实施才能实现其应有的经济效益和社会效益。专利的实施是在社会这个大系统中进行的,必将受到各种环境因素的影响和制约。因为专利的实施必须要与其相关的环境发生关系。从系统论的角度来说,专利的实施只有与其相应的环境相适应,才能为专利的顺利实施提供前提和保证。本文以西安地区高校为例,就专利法实施以来申请的210余件专利从环境因素出发,对高校专利实施的影响予以分析和控讨。
