2005年4月27日第十届全国人民代表大会常务委员会第十五次会议审议通过了《中华人民共和国公务员法》。该法将于2006年1月1日起施行,届时《国务院关于国家行政机关工作人员的奖惩暂行规定》、《国家公务员暂行条例》将废止。这是我国第一部干部人事管理的法律,它的制订颁布是我国民主法制建设的一件大事,是干部人事管理科学化、法制化的里程碑。本文将通过《国家公务员法》和《国家公务员暂行条例》的对比,对新的《国家公务员法》的特点作几点解析。
On April 27, 2005, the 15th meeting of the Standing Committee of the Tenth National People’s Congress examined and approved the Civil Servant Law of the People’s Republic of China. The law will come into effect on January 1, 2006, when the “Interim Regulations on the Reward and Punishment of Staff of State Administrative Authorities” issued by the State Council and the “Provisional Regulations for State Civil Servants” will be repealed. This is the first cadre and personnel administration law in our country. Its formulation and promulgation is a major event in the construction of China’s democratic legal system and a milestone in the scientific and legalized administration of cadres and personnel affairs. In this paper, we will analyze the characteristics of the new “National Civil Servant Law” through the comparison between the “Law on Civil Servants” and the “Provisional Regulations on Civil Servants.”
