WTO争端解决机制是WTO最具创新和独特贡献的部分,被公认为具有准司法化的趋势,其中关于WTO裁决执行的问题一直受到学界的广泛关注。本文通过对中美两国WTO裁决执行的实践和影响因素的考察和分析,认为中美两国在裁决执行方面进行合作是目前促进双方相互执行裁决最有效的方法,并进一步提出了几点加强中美两国执行合作的建议。
WTO dispute settlement mechanism is the most innovative and unique part of the WTO contribution, is recognized as a quasi-judicial trend, of which the implementation of the WTO ruling issues has been widespread concern in academia. Based on the investigation and analysis of the implementation of the WTO ruling in China and the United States and the influencing factors, this paper argues that the cooperation between China and the United States in the enforcement of the ruling is the most effective way to promote the mutual enforcement of ruling between the two countries and further puts forward some suggestions Proposals for China and the United States to implement cooperation.
