当知识运营逐渐成为一种主导的经济增长方式,就意味着“知识经济”[1]将再一次引爆新经济时代的价值高地,20世纪90年代后,文化艺术作品的知识产权(intellectualproperty)逐渐被重视。2011年“旭日阳刚”在央视春晚的一曲《春天里》,与原曲作者兼演唱者汪峰引发的版权问题,再次引起了有关知识产权问题的热议。当然,不仅在流行歌曲领域,在众多的文化艺术作品表演中也存在着诸多违背知识产权保护的问题。目前,以营利性商业演出中所呈现出来的侵犯知识产权行为最为突出与典型。因此,本文从文化艺术市场发展的角度出发,以营利性商业演出为例,对我国知识产权保护的现状、危机及影响因素进行分析,试图找到改善文化艺术领域中,有关知识产权保护若干问题的有效方法。
