委托行政执法的普遍采用,固然有利于提高行政执法效率;但另一方面由于规范缺陷,委托行政行为也陷入行为草率、程序违规、对象错误、监管不力、有权无责的现实困境。因此,以提高执法效率、规范执法行为为目的,围绕着厘定概念、明确要件、固化位阶、规范内容和严格管理等五方面,从行政执法实践角度完善委托行政执法制度是当务之急。
The widespread adoption of administrative law enforcement, of course, is conducive to improving the efficiency of administrative law enforcement; but on the other hand due to regulatory flaws, commissioned administrative acts also fall into the real predicament of abusive behavior, procedural irregularities, wrong targets, ineffective supervision, and powerlessness. Therefore, in order to improve the efficiency of law enforcement and regulate law enforcement activities, it is imperative to consummate entrusted administrative law enforcement system from the perspective of administrative law enforcement practice in five aspects: defining concepts, defining requirements, curing steps, standardizing content and strict management.
