目前,我国海事案件的专业管辖已经名不符实,在实践中造成了司法的不统一;地域管辖明显力不从心且这一矛盾无法在现有体制下得到解决;级别管辖与普通案件的级别管辖不一致,造成诉讼中的不统一、不便利和不经济;海事法院的设置,造成了司法资源的浪费和诉讼成本的增高;海事案件管辖制度和海事法院的设置明显存在法律依据和理论根据方面的不足。据此,撤并我国海事法院、将海事案件划归地方法院管辖,是合理配置司法资源、方便当事人诉讼、方便法院行使审判权和维护司法统一的最佳选择。
