精神损害赔偿是法经济学可以适用的领域,法经济学理论对精神损害赔偿的范围、赔偿数额的确定都开辟了一种新的思维模式,这种思维模式对立法理论以及审判实践都是具有意义的。
Mental damage compensation is the area where law and economics can be applied. According to the theory of law and economics, the scope of compensation for damages and the determination of the amount of compensation all open up a new mode of thinking. This mode of thinking has both the legislative theory and the trial practice meaningful.
