“亲亲相隐”原则其在中国法制史上存在达两千年之久,并非全然是封建糟粕,它具有相当的合理性。在维护封建制度的同时也有对家庭伦理和“孝”“悌”等因素的考量。目前诸多发达国家都有类似“亲亲相隐”的规定,亲亲相隐具有其合理性、可行性。我国承袭“亲亲相隐”以完善我国亲属作证制度,具有重要的现实意义。
“Kiss relatives ” principle In the legal history of China for two thousand years, not entirely feudal dross, it is quite reasonable.
