加强案件管理工作是规范执法行为、提高办案质量、促进执法公正的重要手段。2003年5月最高人民检察院发布了《关于加强案件管理的规定》,但是各地案件管理工作的开展并无统一的模式。传统的案件管理主要实行部门自我管理体制,缺乏规范性和科学性,成为制约检察机关履行法律监督职责的因素之一。检察机关作为法律监督机关,如何解决好监督者的自我监督问题,是摆在各级检察院面前亟待解决的一大课题。在科学技术飞速发展、信息技术得到广泛应用的今天,需要我们在当前案件管理工作中对如何构建程序与实体并重的案件管理体系模式进行认真实践、积极探索。 Strengthening case management is an important means of regulating law enforcement activities, improving the quality of handling cases and promoting the fairness of law enforcement. In May 2003, the Supreme People’s Procuratorate promulgated the “Regulations on Strengthening the Management of Cases”, but there is no uniform model for carrying out cases management around the country. Traditional case management is mainly implemented by the departmental self-management system, which lacks normative and scientific characteristics and becomes one of the factors restricting the procuratorial organs from performing their duties of legal supervision. As a supervisory organ of the law, the procuratorial organs should solve the issue of self-supervision of the supervisors in order to solve the problems that need to be solved before the procuratorates at all levels. Nowadays, with the rapid development of science and technology and the wide application of information technology, we need to seriously practice and actively explore how to build a case management system model that emphasizes both procedures and entities in the current case management work.
