一、罚金刑的易科制度罚金刑的易科亦称为易刑制度或换刑处分。其内容包括有:(一)以罚金代替所科处的徒刑。(二)以其刑罚代替所科处的罚金刑。然而在我国,罚金易科制度仍是法学理论界与司法界的一个禁区,并未在法典中加以规定。笔者认为:《澳门刑法典》所规定的罚金刑易科制度,对我国刑法的修改具有借鉴意义。根据《澳门刑法典》的规定,罚金易科主要有以下几种。
