独立抽象原则是信用证制度的基石,在UCP600及UCC中的规定非常明确。该原则使得银行在信用证下的付款义务相对清楚,即只要受益人提交的单据与信用证要求相符,银行就必须付款,而不受基础合同及其他信用证的影响。对维护作为当今国际贸易主要支付手段的信用证制度的稳定性起着至关重要的意义。
The principle of independence and abstraction is the cornerstone of the letter of credit system. The rules in UCP600 and UCC are very clear. This principle makes the bank’s obligation of payment under the letter of credit relatively clear, that is, as long as the documents submitted by the beneficiary comply with the requirements of the credit, the bank must pay, without being affected by the basic contract and other letters of credit. It is of crucial importance for the maintenance of the stability of the letter of credit system, which is the main means of payment for international trade today.
