所有权的必要性在于它是人的自由可以普遍共存的必要条件,在自然状态之中个人虽然可以在经验上占有某个外在物,却并不因此能够拥有真正意义上的所有权。所有权的权能要求个人的单方的意思表示能够约束所有其他人的意愿,而这只有在存在普遍的外在立法的前提下才有可能。国家的存在因此是个人的所有权成为可能的必要的构成性条件,而非保护所有权的单纯的手段。
The necessity of ownership is that it is a necessary condition for the common coexistence of human freedom. In the natural state, individuals may not have real ownership even though they may possess some extrinsic things empirically. The power of ownership requires that the unilateral meanings of the individual represent the will to bind all others, which is possible only if universal external legislation exists. The existence of the state is therefore a necessary constitutional condition that is possible for individual ownership, not a mere means of protecting ownership.
