国际环境法对中国环境法的发展意义重大,但在中国的法律制度如何接受国际环境法这一问题上,仍存在很多争议。本文首先介绍了中国适用国际条约的一般做法,并以此为基础分析了国内环境法规如何与国际条约法相联系,最后通过对两个判决的比较研究,表明依靠援引条款来适用国际条约的困难性。 International environmental law is of great significance to the development of Chinese environmental law. However, there are still many controversies over how China’s legal system accepts international environmental law. This article first introduces the general practice of China’s application of international treaties and analyzes how domestic environmental laws and regulations are linked with international treaty law. Finally, through a comparative study of the two judgments, it shows that the difficulty of applying international treaties by invoking provisions .
