旅游合同这种以精神利益为导向的合同,旅游者因违约行为受到精神损害,是否可以请求精神损害赔偿的问题,目前还有争议。本文分析了我国旅游违约精神损害赔偿制度的立法现状及相关司法实践,从四个方面论述了旅游合同中违约精神损害赔偿制度的存在具有合理性。
There is still controversy over the issue of tourist contracts that are oriented toward the interests of the mind, that tourists are mentally damaged as a result of a breach of contract and whether they can request compensation for moral damages. This article analyzes the legislative status quo and related judicial practice of China’s compensation system for the spirit of tourism default and discusses the reasonableness of the existence of the compensation system for the damages of breach of contract in tourism contracts from four aspects.
