近日,北京市朝阳区法院双桥法庭公开开庭审理了一起涉及买卖购车指标引发的不当得利纠纷案件。原告白某为帮其朋友办理北京市车牌,与被告查某协商通过查某为其购买北京市车牌号,并支付查某预付款10万元,后因查某未能如期办理,白某诉至朝阳区法院要求查某返还不当得利10万元并支付相应利息。查某则称其并非为白某办理北京市购车指标,而是为其购买吉祥车牌号,不能办理的原因在于白某未提供北京市购车指标,10万元系定金,并非不当得利。
