自《中华人民共和国政府信息公开条例》正式实行后,我国公民对政府公开信息的愿望不断高涨,政府信息公开行政诉讼的案件也随之增多。政府信息公开诉讼,其保护的是诉讼中相对人的知情权,知情权是我国宪法赋予公民表达自由的一项重要权利。文章主要讨论的是政府信息公开的范围、政府信息公开的判决方式以及处理政府信息公开案件的思路和方法。
Since the official implementation of the “Regulations Governing the Opening of Government Information in the People’s Republic of China,” our citizens’ wishes toward the open information of the government have been on the rise. The number of administrative litigation cases involving government information has also increased. The government information disclosure lawsuit protects the relative right of people in the lawsuit. The right to know is an important right granted to the citizens by our country’s constitution to express freedom. The article mainly discusses the scope of the government information disclosure, the way of judging the government information disclosure and the ideas and methods to deal with the government information disclosure cases.
