最近,江苏省海门市人民法院审理了一起提供劳务者受害责任纠纷。2012年,樊某和张某挂靠的出国劳务公司签订劳务派遣及雇佣合同。在向张某支付报名费后,樊某被安排至非洲某国家从事建筑工作。2015年4月,张某向樊某送达了解除合同通知书,提前解除雇佣合同并送原告归国。回国10天后,樊某感到身体不适,经医院诊断罹患恶性疟疾。为治理该病,樊某辗转多家医院,支付了医疗费10余万元。后同张某及其所挂靠的出国劳务公司多次协商赔偿未果,樊某诉至法院。
Recently, Haimen People's Court of Jiangsu Province handled a dispute over the responsibility of providing labor services. In 2012, Fanmou and Zhang affiliated overseas labor service companies signed labor dispatch and employment contracts. After paying the registration fee to Zhang, Fan was arranged to engage in construction work in a country in Africa. In April 2015, Zhang served Fan Fan with notice of termination of contract, early termination of employment contract and return of plaintiff to China. Ten days after returning home, Fan felt ill and was diagnosed with malignant malaria by the hospital. To manage the disease, Fan removed a number of hospitals, paid more than 10 million medical expenses. After the same Zhang and its affiliated labor service companies negotiated compensation failed several times, Fanmou sued the court.
