中国和东盟各国的外资优惠政策存在针对性差、优惠程度悬殊、以业绩要求作为获惠条件以及优惠政策朝令夕改之缺陷。国际投资条约固然不宜直接规定优惠制度的实体内容,但它可以规定各国要提高优惠政策的透明度,并以条约义务的形式确保优惠政策的公开性和可预见性。目前,中国和东盟之间的投资条约在透明度问题上存在着法律文件公开时间模糊不清和行政程序公开尚处空白之不足,因此,应从国内法层面和国际法层面加以完善。
The preferential policies for foreign investment between China and ASEAN countries are poorly targeted and the degree of preferential treatment is very poor. Performance requirements are used as a prelude to favorable conditions and preferential policies. While it is not appropriate for the international investment treaties to directly regulate the substantive content of the preferential regime, it may stipulate that all countries should increase the transparency of preferential policies and ensure the openness and predictability of preferential policies in the form of treaty obligations. At present, the investment treaty between China and ASEAN has the problems of transparency in the disclosure of legal documents and the openness of administrative procedures. Therefore, it should be perfected from the perspective of domestic law and international law.
