中古西欧的骑士文学和教会法以各自不同的方式批判了封建婚姻,鼓吹人性和爱情,形成12世纪人文主义复兴的两个侧面。骑士文学和教会法的爱情婚姻观有差异,也有许多相通之处,都极力肯定以爱情为基础的婚姻。骑士爱基本上是贵族文化的一部分,世俗的性质比较浓重;而教会的婚姻法具有深刻的宗教性以及由此而来的社会平等观念,兼顾平民的利益,对妇女的地位也颇有维护。为保护贵族的社会地位和经济利益,封建法强调妇女的贞操。而根据教会法,通奸的男子和女子应受同样的处罚。与骑士文学相比,教会法对个人情感的重视和支持要更全面、更彻底一些。
The knight-errant literature and church law in medieval Western Europe criticized the feudal marriage in their own different ways, advocating human nature and love, and formed two sides of the revival of humanism in the 12th century. Knight literature and church law of love and marriage are different, there are many similarities, are strongly affirmed love-based marriage. Knight love is basically a part of aristocratic culture, the secular nature of the more concentrated; and the church’s marriage law has a profound religious and the resulting social equality concept, taking into account the interests of civilians, women’s status is quite maintained. In order to protect the social status and economic interests of aristocrats, the feudal law emphasized the virginity of women. Under the church law, men and women who commit adultery are subject to the same punishment. Compared with the knight literature, the emphasis and support of the church law on personal feelings should be more comprehensive and thorough.
