从犯罪和犯罪主体的角度来看,国际犯罪与责任涉及个人和国家两个方面。由于实施国际犯罪的个人身份不同,个人的国际犯罪大致可以分为两种类型:一种是个人以私人身份实施的国际犯罪;另一种是个人以国家代表的身份或者作为代表国家行事的人实施的国际犯罪。当有管辖权的国际刑事法庭乃至国际刑事法院对实施后一种个人国际犯罪的罪犯进行审判时,必然存在一个引渡罪犯的问题。本文拟就向国际刑事法庭乃至国际刑事法院移送罪犯的特殊性略陈意见。
From the point of view of crime and criminal subjects, international crimes and responsibilities involve both individuals and countries. Owing to the different personal identities of implementing international crimes, the international crimes of individuals can be broadly classified into two types: one is an international crime committed by an individual in a private capacity and the other is an individual’s identity as a state representative or as a person acting on behalf of the State International crime committed. When international criminal tribunals with jurisdiction and even the International Criminal Court try the criminals who commit the latter individual international crimes, there must be a question of the extradition of criminals. This article is intended to make some comments on the particularity of transferring criminals to the International Criminal Court and the International Criminal Court.
