混合法域:普通法法系与民法法系——法典化与非法典化

普通法法系与民法法系在历史传统、样式、理论与实践等方面存在相当的差异,但是在一些特别的国家或地区,来自普通法法系、民法法系以及其他法律传统的因素共同促成了一种特殊的法律体系——混合法律体系,这些国家或地区成为混合法域。本文的目的即在于提供一种关于混合法律体系和混合法域的综合观点。本文在界定法律体系、法律传统、民法和普通法、制定法、混合法律体系和混合法域的概念的基础上,辨别、评估了民法和普通法两大法律传统在方法、风格、解释和规则等方面的不同之处;同时考察了民法法系的一些原则对当代普通法的影响,历史上的“商人法”、现代商事惯例法促成跨国、跨法系商法的影响;以及论述了苏格兰、南非、魁北克、路易斯安那、埃及等混合法域的历史发展和现实特征,它们可以是法典化的或者是非法典化的法域。一个混合法域的长期存在,是由该法域至少存在两种官方语言或者至少是广泛使用的语言、双重立法体系以及双重司法体系、对不同法律传统都有深刻理解的法律人等因素所支撑的。民法与普通法传统或者其他法律传统都为混合法域做出了有价值的贡献,应得到平等的尊重和保留。只有这样,世界上不同法律传统的融合才能真正地丰富和巩固民族与国际法律文化。 There are considerable differences in the history, style, theory and practice between the common law and civil law jurisdictions, but in some special countries and regions, the common law and civil law and civil law and other legal traditions contribute together A special kind of legal system - a hybrid legal system that has become a mixed jurisdiction. The purpose of this article is to provide a comprehensive view of mixed legal systems and mixed jurisdictions. On the basis of defining the legal system, legal tradition, civil law and common law, lawmaking, mixed legal system and the concept of mixed jurisdictions, the dissertation identifies and assesses the methods, styles, interpretations and rules of the two legal traditions of civil and common law At the same time, it examines the influences of some principles of the civil law system on the contemporary common law, the historical “merchant law ” and the modern commercial practice law to promote the transnational and cross-legal system of commercial law; and discusses the Scottish , South Africa, Quebec, Louisiana, Egypt and other hybrid jurisdictions historical development and realistic characteristics, they can be a codified or non-codified jurisdictions. The long-standing existence of a hybrid jurisdiction is supported by at least two official languages ​​of the jurisdiction, or at least the widely used language, the dual legislative system and the dual judicial system, legal persons who have a profound understanding of different legal traditions. Both civil and common law traditions or other legal traditions make a valuable contribution to a hybrid jurisdiction and deserve equal respect and retention. Only in this way, the integration of different legal traditions in the world can really enrich and consolidate the national and international legal culture.
