诉讼权利平等是我国民事诉讼法中确立的一项基本原则。然而,在我国现行的民事诉讼法律中,仍然存在着一些双方当事人之间权利不平等的现象。本文笔者站在被告的立场上,以民事诉讼双方当事人在诉讼程序中权利的平等为切入点,以原告享有的撤诉权为视角,加以探讨,在原告享有撤诉权的情况下,被告应该具有什么样的权利与之相匹配,从而达到原告与被告之间真正意义上的权利平等。 Equality of litigation rights is a basic principle established in the Civil Procedure Law of our country. However, in our current law of civil procedure, there still exist some inequalities of rights between the two parties. From the standpoint of the defendant, this article starts with the equality of rights of both parties in civil litigation as the starting point, and discusses with the plaintiff’s power of withdrawing the right of litigation. If the plaintiff has the right to withdraw the litigation, what should the defendant have? The right match with it, so as to achieve the plaintiff and the defendant in the true sense of equality of rights.
