张世明教授的《法律、资源与时空建构:1644-1945年的中国》用总体史方法,从事实与规范两方面结合,考察近了300年来中国法律的产生过程,为理解当代中国法律的现状和问题症结提供了全角度的有效路径。清代军事作为国家调动资源最密集的行为,显示了国家组织权力的思维和行动方式,并由此影响到法律产生和发展的方向。法律参与了资源的时空建构,也受其制约,从军事的角度可以理解近代中国法律走向的底层规则。
Professor Zhang Shiming’s “Law, Resources and Space-time Construction: China in 1644-1945” combines the facts and the norms with the overall history method and examines the emergence of Chinese law in the past 300 years. In order to understand the status quo of contemporary Chinese law and The crux of the problem provides a full range of effective path. As the most intensive mobilization of resources by the state, the military affairs of the Qing dynasty showed the thinking and mode of action of the power of the state organizations and thus influenced the emergence and development of law. Law participates in the construction of space-time resources, but also constrains them from the military point of view to understand the underlying rules of modern Chinese law.
