中国私募基金业实践中不断演变,出现了去创投化(二级市场化)、互联网化、国际化(离岸化)、多元化等新趋势,这无疑也是PE主体多元化、PE客体多元化与PE法律模式的多元化,也就是新的PE法律关系的多元化,这就对PE监管和专业服务提出了更高的要求。如何在创新模式下去设计更精细的交易架构,以合理配置和界定PE各方权利、义务和责任,从而精准满足PE日趋复杂而多样的合理商业需求,已成为摆在监管部门和专业机构面前的一大挑战。
