《里斯本条约》将欧洲检察官办公室明文规定在与警务与刑事司法合作相关的篇章中。欧洲检察官职务的变迁是欧盟警务与刑事司法合作发展的一个缩影,欧洲检察官办公室的成立是此合作的阶段性成果。欧洲检察官办公室推动着欧盟司法领域的合作,欧盟司法领域的合作反过来又影响着欧洲检察官办公室的未来走向。从具体设计和发展来看,欧盟警务与刑事司法合作越来越趋向于超国家性质。欧洲检察官及欧盟警务与刑事司法合作给我国的启示是:为了使其走向法治、科学和统一,必须修订国内相关立法;在与其他国家及欧盟合作时,要在维护国家利益与合作之间取得平衡,完善合作模式,用一体化思维塑造区域性系统。
The Lisbon Treaty explicitly sets the European Public Prosecutor’s Office in the context of police and criminal justice cooperation. The change of European prosecutor’s position is a microcosm of the development of cooperation between the EU police and criminal justice. The establishment of the European Prosecutor’s Office is a staged result of this cooperation. The European Prosecutor’s Office is promoting cooperation in the judicial field of the EU and the cooperation in the EU judicial field in turn affects the future direction of the European Prosecutor’s Office. Judging from the specific design and development, the EU police and criminal justice cooperation tends to be more and more super-national in nature. The enlightenment our European prosecutors and EU police and criminal justice cooperation have for our country is that in order to make them governed by the rule of law, science and reunification, the relevant domestic legislation must be amended. In the cooperation with other countries and the EU, we must safeguard national interests and cooperation Striking balance, improving the cooperation model and shaping the regional system with integrated thinking.
