在知识经济的时代,科学技术已经成为第一生产力,只有凭借先进技术才能占领经济市场。我国若想在该领域占有一席之地,必须在不断进行技术创新的同时,发挥《专利法》的权威指导地位。首要的,便是确定专利法的立法方向,即立法宗旨,而立法宗旨的关键便是价值取向的选择。这便需要分析诸多影响其选择的因素:我国发展现状、国际影响以及相应的各种理论制度等。
In the era of knowledge-based economy, science and technology have become the primary productive forces, and the economic market can only be occupied by virtue of advanced technologies. If our country wants to occupy a place in this field, we must give full play to the leading position of the authority of the Patent Law while constantly carrying out technological innovations. The first and foremost is to determine the legislative direction of the patent law, that is, the purpose of legislation. The key to the legislative purpose is the choice of value orientation. This needs to analyze many factors that affect their choice: the current situation of development in our country, the international influence and the corresponding theoretical systems.
