关于“非犯罪化”(Decriminalization)研究的不断深入与扩展是二十世纪中叶以来世界各国刑法思想与实践最具时代性的变迁与进步,对传统刑法观念产生了极大的冲击。无论是英美法系还是大陆,也无论是学术思想还是立法、司法都深受其影响,是推动世界范围内刑法变革思潮的巨大动力。近几十年来它一直是各国刑法理论与实务界热烈关注与探讨的问题之一,对于各国的刑事立法以及司法实践,产生了不可忽略的影响。
The deepening and expansion of the research on “Decriminalization ” has been the most epoch-making change and progress in the thinking and practice of criminal law in various countries in the world since the mid-20th century, which has had a great impact on the concept of traditional criminal law. Both Anglo-American legal system and mainland China, both academic ideas and legislation, and judiciary are deeply influenced by them, which is a great impetus to promote the trend of criminal law reform around the world. In recent decades, it has always been one of the issues that have been paying attention and discussion to the theory and practice of criminal law in various countries. It has had a significant impact on criminal legislation and judicial practice in various countries.
