近年来,在中小学校因教师过度惩戒所致之学生伤害案件不断发生,因教师放任不管所致之学生伤害案件也时有发生。同样,在高校教师惩戒滥用的现象也是屡见不鲜的。老师究竟该不该管学生?应该管到什么程度?这是现有的教育法律体系留给全体教师的困惑。以法经济学的视角分析教师惩戒权问题,借鉴经济学中的希克斯改进理论论证通过制度化的方法来解决当前教师惩戒法律制度中存在的问题,完善教育法律法规中关于教师惩戒权的相关规定,是很有必要的。
In recent years, cases of student injury caused by over-discipline of teachers in primary and secondary schools have continued to occur. Cases of student injuries caused by disregard of teachers have also occurred from time to time. Similarly, it is not uncommon for teachers in colleges and universities to discipline abuses. To what extent should the teacher control the students? This is the confusion left by the existing education legal system to all the teachers. Analyze the problem of teacher’s disciplinary power from the perspective of law and economics, learn from Hicks theory of improvement in economics to solve the problems existing in the current teacher’s disciplinary system of law through institutionalized methods, improve the law of education on teachers’ right to discipline The relevant provisions are necessary.
