2013年底,全国人大常委会宣布废止劳动教养制度,存活了长达58年的劳教制度寿终正寝,被视为新一届政府推动法治建设的重要进步和标志。然而,劳教虽已废除,类似的制度仍有存留。2014年5月,演员黄海波因“嫖娼”被处行政拘留15日,期满后北京警方决定对他进行为期6个月的收容教育。此次事件,牵出法律界和公众关于收容教育制度的存废之争。
At the end of 2013, the NPC Standing Committee announced the annulment of the system of re-education through labor and the end of the re-education system that lasted for 58 years. It is regarded as an important progress and symbol of the new government in promoting the rule of law. However, although reeducation through labor has been abolished, a similar system still exists. In May 2014, actor Huang Haibo was placed in administrative detention for “prostitution” 15 days after the expiration of which the Beijing police decided to give him a six-month housing education. The incident brought the legal profession and the public on the shelter education system of the dispute.
