刑事和解作为恢复性司法理念孕育出来的新型司法制度,已经成为许多国家刑事法律政策的重要内容和刑事法律制度改革的重要方向,对我国的刑事司法改革和整个刑事司法领域一体化进程提供了崭新的思路。在构建和谐社会的时代背景下,应充分借鉴国外刑事和解的理论与经验,积极探寻和整合本土资源,并结合我国已有的刑事司法实践,构建适合我国国情的刑事和解制度。
The new justice system that criminal reconciliation conceived as the concept of restorative justice has become an important part of criminal law and policy in many countries and an important direction of the reform of the criminal law system. It has provided a brand-new aspect for the criminal justice reform and the entire criminal justice field integration process in our country Train of thought. Under the background of building a harmonious society, we should draw lessons from the theory and experience of criminal reconciliation in other countries, actively explore and integrate local resources, and build a criminal reconciliation system that suits the national conditions of our country in light of China’s existing criminal justice practice.
