一部法律草案进入立法程序后整整十年没有声息,这在中国改革开放以来的立法史上大概是十分罕见的事。《中华人民共和国民法(草案)》就是这部法律草案。2002年12月23日,这部法律草案首次提交第九届全国人民代表大会常务委员会第三十一次会议审议,标志着中国民法典正式进入了立法的程序。如今,十年过去了,虽然民事立法仍在进步,但并未见立法机关第二次审议这部法律草案。〔1〕按照《立法法》第39条之规定,全国人民代表大会常务委员会会议审议的法律案,因故“搁置 A full decade after a draft law enters the legislative process has no sound.
