高校学业评价权是一种以学术权力为主、行政权力为辅的权力。学业评价权体现了教育目的性的特殊“部分社会性”特质,学生与学校之间是一种修正的特别权力关系。学业评价行为产生间接的法律效果。学业评价行为具有较强的专业性,因此司法应进行有限审查,不审查专业问题,对法律问题进行程序审查。在司法介入时机上,可以通过审查具体行政行为起到间接审查学业评价行为的作用。
The academic evaluation right in colleges and universities is a kind of power mainly based on academic power and supplemented by administrative power.
